
To obtain a TRC, you must meet specific criteria:
Individuals: Must have resided in the U.S. for more than 182 days in a single tax year.
Companies: Must have been registered and operating in the U.S. for at least three years before applying.
While most U.S. registered companies can apply, offshore companies are not eligible for a TRC. However, they may be able to apply for a separate tax exemption certificate that makes them tax-exempt under U.S. law.
There are some procedures to apply for a Tax Residency Certificate in India. Once the documents are submitted with the application, the certificate is issued within two months. The company should have been in India for at least three years before applying for the TRC.
